Work Permit

  • A foreigner must have a residential permit and work permit to work in Turkey.
  • The foreigners who works without work permit and their employers will have a serious amount of penalties. For this reason, the necessary permits should be provided from relevant institutions.
  • Getting work permit is mandatory for foreigner servant and nanies because of  their numbers are increasing in our country day by day.

There are two ways to get work permit in Turkey:

  • The foreigners who are residing out of Turkey can apply to Turkish Consulate / Embassy in their country.
  • The foreigners who have residence permit of 6 months minimum in Turkey can apply to Ministry of Labor directly.
  • In case of the documents have been delivered us completely, providing time of work permit will be 30 days approximately.

THE NECESSARY DOCUMENTS FOR GETTING WORK PERMIT:

The documents that would be provided by the foreigner staff:

  • A work permit request petition that is addressed to Ministry of Labour
  • Foreign staff application form (With a photo that is taken within last six month and original signature of the foreign staff and the employer – 4 original copies)
  • Passport copy translated to Turkish and approved by notary
  • A notarized and translated in Turkish copy of the diploma
  • Notarized copy of residence permit (It must have a duration of at least 6 months and the application must be made within this time period.)

If the foreigner staff has been appointed from abroad, key personel or representative of the shareholder, a document that proves his/her situation and provided by the employer with approval by the relevant authorities

The documents that would be provided by the employer:

  • A petition that is addressed to Ministry of Labour

  • Balance sheet and income sheet of the current year that are approved by the tax office
  • The original or the certified copy of the trade registry gazette that shows the most recent capital and shareholdering structure of the company
  • An original document that approves the situation of the foreigner staff if he/she is registered to social security system in his/her own country and the notarized and translated copy of it
  • The Premium bill of the last month that shows the status of registration to Bagkur and Social Security Institute for all the Turkish and foreigner staff who Works in the company that applied to work permit

Evaluation criteria which must be covered by the employers who applied to work permit and the foreigner staff:

Employing of Republic of Turkey citizens: Employment of at least five Republic of Turkey citizens is required in the workplace that applied to the work permit. In case of the personel who has requested work permit is a partner of a foreign company, five Turkish employee condition is soght for six month of a one-year work permit. If the work permit will get for more than one employee in the same workplace, five employee condition will also be sought for the foreigner personnel after the first personnel who has got work permit.

  • The Capital Amount of the Company: The paid-in capital of the company must be 100.000 TL or the gross sales must be 800.000 TL or current year export amount must be 250.000 US Dollar at least.
  • Exemptions: The capital amount condition will not be sought for the foreigners who will work in associations and foundations. Both capital amount and employment of Turkish Republic citizen condition will not be sought for the  foreigners who will be work in the representatives of the foreigner airlines, education sector and house services.
  • The capital share of the foreigner company partner who has requested work permit has to be at least %20 by the condition of not less than 40.000 TL.
  • The Salary That Would be Paid to the Foreigner: The salary that would be paid to the foreigner personnel  must be  at least:
  • 6,5 times of the minimum wage for senior executives, pilots and engineers and achitectures who has requested pre-permit
  • 4 times of minimum wage for unit or branch managers and engineers and architectures
  • 3 times of the minimum wage for the foreigners who will work in the positions that requires expertise, teachers, psychologists, physiotherapists, masseur, massuese, musicians, performing artists, acrobats
  • 1,5 times of the minim wage for the foreigners who will work in house services and other jobs (salespeople, marketing and export tasks, etc.)
  • Employment of Turkish Republic citizens and capital amount condition will not be sought fort he foreigners who will work in case of there are terms in the bilateral or multilateral agreements which Turkey is a party, and the foreigners who will be employed by the public institutions and organizations in the jobs of purchasing  goods and services by contract or bids.
  • The condition of Turkish Republic citizen employment fort he foreigners who will be employed except of key personnel in the workplaces with the terms of the Special Foreign Direct Investment will be executed on the basis of the number of Turkish Repblic citizens who works in the establishments of the company throughout Turkey.
